The exact language for the Texas Executive order about wearing masks – Every person in Texas shall wear a face covering over the nose and mouth when inside a commercial entity or other building or space open to the public, or when in an outdoor public space, wherever it is not feasible to maintain six feet of social distancing from an other person not in the same household.
This means a mask is required when in close proximity to others. There are dozens of exceptions including exercising, eating, and drinking. Walking down an empty sidewalk is considered exercise and therefore exempted. Wearing a mask responsibly while in the proximty to others makes sense. City ordnance adopted similar language and privately owned businesses have to oblige. Store policy is more strict than state law in this case. People with asthma are exempted from the mask requirment on a city and state level however individual store policy rejects that and that is the kink in this whole thing. If you walk into a store with a mask policy drinking something, you are exempted however store staff will turn asthmatic people away because the opposite side of this issue is businesses aligning accurately to the rules. It’s currently legal to prevent people with breathing issues from going without a mask into a store. Because stores have the right to refuse service to anyone. It’s a mess.
